Parties
a) AYSİRA TEKSTİL SANAYİ TİCARET A.Ş., which carries out the activities of www.aysirashop.com website, having its residence at Sırrıpaşa Mah. Denizciler Cad. No:234 Derince / Kocaeli , (hereinafter referred to as the AYSİRA).
b) ........ internet user, who is a member of www.aysirashop.com website (“Member”)

2. Subject Matter of the Agreement
The subject matter of this present Agreement is to establish the conditions for benefiting by the member from the website owned by Aysira, which is www.aysirashop.com.

3. Rights and Obligations of the Parties
3.1. The member declares and undertakes that the personal and other information the member has provided when being a member to the website, www.aysirashop.com, is correct before the laws and that the member will compensate Aysira immediately and in kind for any damages to be suffered due to misstatement of that information.

3.2. The member may not give to other persons and entities the password given to him/her by Aysira, the right of the member to use that password belong to him in person. Aysira’s any compensation right and other kind of request against all allegations and claims that may be raised against Aysira by third persons or competent authorities that may be due for this reason are reserved.

3.3. The member agrees and undertakes in advance to adhere to and not to violate legal legislation provisions when using www.aysirashop.com website. Otherwise, all legal and criminal liabilities arising thereof shall entirely and exclusively bind the member.

3.4. The Member may not use the website aysirashop.com in any manner to violate the public order, contrary to public morality, to disturb and harass others, for an illegal purpose and to infringe on the intellectual and copyright of others. In addition, the member may not involve in any operations (spam, virus, trojan horses, etc.) that make it difficult for others to use or prevent others from using the services.

3.5. The ideas and thoughts stated and written by members on www.aysirashop.com website are entirely personal opinions of the members and bind that opinion holder. These ideas and opinions have no relevance to and connection with Aysira. Aysira has no responsibility for the damages that may be incurred by third persons due to ideas and opinions to be stated by the member and for damages that may be incurred by member due to ideas and opinions to be stated by third persons.

3.6. Aysira shall not be responsible for reading of the member data by unauthorized persons and for the damages that may be given to member software and data. The Member has agreed in advance not to claim any compensation from Aysira due to any damage that the member may incur for use of the website www.aysirashop.com.

3.7. The Member has agreed not to access to or use other internet users’ software and data without permission. Otherwise, the legal and criminal liabilities to arise therefrom belong entirely to the member.

3.8. The member who violates one or more provisions listed in this present membership agreement shall be criminally and legally liable in person due to such violation, and shall hold Aysira harmless against legal and criminal consequences of these violations. Also, in case that such a violation is brought to the field of law, Aysira’s right to claim a compensation against the member due to failure to comply with the membership agreement is reserved.

3.9. Aysira has always the right to unilaterally delete the membership of the member when required and to delete the file, document and information of the customer. The Member agrees this disposal in advance. In this case, Aysira has no liability.

3.10. www.aysirashop.com website software and design is the property of Aysira, and copyrights and/or other intellectual property rights thereof are protected by laws, and these may not be used, acquired and modified by the member without permission. Other companies and products mentioned on this website are trademarks of their owners and also protected under intellectual property rights.

3.11. For the purposes of improvement and development by Aysira of www.aysirashop.com website and/or within the framework of legal legislation, some information such as name of the Internet service provider and Internet Protocol (IP) address used to access to the website, date and time when the Website is accessed, pages accessed during the connection to the website, and internet address of the Website providing a link to the website, may be collected.
 
3.12. Aysira may disclose personal information of the member when required as a legal obligation or in cases where it is convinced in good faith that disclosure of such personal information is required (a) to act in accordance with legal requirements or to comply with the legal proceedings notified to Aysira; (b) to protect and defend rights and property of Aysira and www.aysirashop.com website family.

3.13. Measures have been taken within the bounds of possibility to ensure that www.aysirashop.com website is free of viruses and similar software. Besides this, in order to ensure ultimate security, the user must supply his/her own virus protection system and ensure to have the required protection. Within this context, the user, by access to www.aysirashop.com website, is deemed to have accepted that he/she is responsible for all errors and their direct and indirect consequences that may occur in his/her software and operating systems.

3.14. Aysira reserves the right to change the content of the site at any time, to change or terminate any service provided to users or to delete user information and data stored on www.aysirashop.com website.

3.15. Aysira may amend, update or cancel the terms of the membership agreement without any prior notice and/or warning. Each amended, updated or repealed provisions shall take effect on the date of publication for all users.

3.16. The parties agree and declare that all computer records of Aysira shall be taken as a basis as a real exclusive evidence in accordance with article 287 of CCP (Civil Code of Procedure) and that such records shall constitute an evidential agreement.

3.17. Aysira has the authority to send informational e-mails to electronic mail addresses of its members recorded with it and SMS messages to their mobile phones as per this present membership agreement, however, the member, with his/her approval of this present membership agreement, is deemed to have agreed to receive informational mails to his/her electronic mail address and informational SMS messages to his/her mobile phone. 

4. Termination of the Agreement
This agreement shall remain in force until the member cancels his/her membership or Aysira cancels his/her membership. If the member violates any provision of the membership agreement, Aysira may unilaterally terminate the membership of the member.

5. Resolution of Disputes
Kocaeli Courts and Enforcement Offices are competent authorities in disputes with respect to this present agreement.

6. Entry Into Force
Registration of the member made by the member himself/herself means that the member has read all articles in the membership agreement and accepted the articles contained in the membership agreement. This present Agreement has been executed at the moment when the member becomes a member, and put into force mutually.
